EU AI Act Enforces New Deepfake and Chatbot Transparency Rules

New transparency regulations under the European Union’s sweeping AI Act are set to take effect on August 2nd, introducing mandatory labeling requirements for deepfakes and AI-generated content. These rules aim to ensure that individuals living within the bloc remain fully informed whenever they engage with artificial intelligence systems.

The legislation mandates that AI providers design their systems to explicitly notify users when they are interacting with AI. Furthermore, developers must incorporate machine-readable marks into their products to facilitate the detection of content that has been manipulated or generated by artificial intelligence.

Specific requirements apply to any organization operating a chatbot, including government agencies, customer service departments, and websites. These entities must inform users that they are communicating with an AI rather than a human, unless the context already makes the use of AI obvious. For instance, if a user is presented with a clear prompt such as "ask our AI chatbot for more information," the requirement is satisfied.

According to the regulations, this disclosure must be easily understandable and clearly displayed at the appropriate time during the user experience. It remains the responsibility of the chatbot provider to ensure their system design effectively conveys this information to the user.

These rules apply to all new chatbots operating within the European Union starting August 2nd. Existing chatbots have been granted a transition period until December 2026 to achieve compliance, though many providers have already implemented such measures.
